Children less than 13 years of age


Children under the age of 13 years cannot give valid consent.

Find a competent adult with parental responsibility who can give consent, and get consent from them. Note, you only need obtain consent from one competent adult who has parental responsibility, even if the other(s) who hold parental responsibility refuse to give consent.


If the competent adult(s) refuses to give consent for treatment you deem necessary and in the child’s best interests, obtain consent from the court, or in the rare circumstances of a life threatening emergency treat the child under the doctrine of necessity in their “best interests”.
